General Terms and Conditions of Use for the Ascanium website and it’s subdomains

Preamble

These general terms and conditions of use are concluded between:

– the operator of the website, hereinafter referred to as the “Publisher”,

– any person wishing to access the website and its services, hereinafter referred to as the “User”.

Article 1 – Principles

The purpose of these general conditions of use is to provide a legal framework for the use of the Ascanium website and its services.

The General Terms and Conditions of Use must be accepted by all Users, and access to the site implies acceptance of these conditions.

Article 2 – Evolution and duration of the GTCU

These general terms and conditions of use are entered into for an indefinite period. The contract takes effect with regard to the User from the start of use of the service.

The Ascanium site reserves the right to modify the clauses of these general conditions of use at any time and without justification.

Article 3 – Access to the site

Any User with access to the Internet may access the Ascanium site free of charge from anywhere. The costs incurred by the User to access the site (internet connection, computer equipment, etc.) are not the responsibility of the Publisher.

The site and its various services may be interrupted or suspended by the Publisher, such as for maintenance purposes, without prior notice or justification.

Users of the site have access to the following services: Office and workspace rental, business centre and domiciliation services and services to companies and individuals.

The site includes a paying members’ area reserved for registered users. These users will be able to access it using their login details. 

The services reserved for members are as follows: A platform for members to manage their accounts, subscriptions, rentals, and member services.

Licence to use the content of the site

By connecting to the site, the user agrees to accept from ASCANIUM SAS a licence to use the content of the site strictly limited to the following imperative conditions:

This licence is granted on a non-exclusive and non-transferable basis.

The right of use granted to the user/internet surfer is personal and private: in other words, any reproduction of the content of the site on any medium whatsoever for collective or professional use or for sharing or referencing, even internally within a company, is prohibited. The same applies to any communication of this content by electronic means, even on a company intranet or extranet.

The right of use only includes authorisation to consult the site and its content.

This use only includes authorisation to reproduce for storage for the purposes of representation on a single-user screen and reproduction in one copy, for back-up copies and hard copies.

Article 4 – Liability 

The Publisher may not be held liable in the event of any failure, breakdown, difficulty, or interruption in operation preventing access to the site or to any of its functions.

The equipment used to connect to the site is the sole responsibility of the User, who must take all appropriate measures to protect the equipment and data, such as from viral attacks via the Internet. Users are also solely responsible for the sites and data they consult.

The Publisher may not be held liable in the event of legal proceedings against the User:

  • as a result of use of the site or any service accessible via the Internet.
  • as a result of the User’s failure to comply with these terms and conditions.

The Publisher shall not be liable for any damage caused to the User, third parties and/or the User’s equipment as a result of the User’s connection to or use of the Site, and the User hereby waives all claims against the Publisher in this respect.

Should the Publisher be the subject of amicable or legal proceedings as a result of the User’s use of the Site, it may take action against the User to obtain compensation for all damages, sums, fines and costs that may arise from such proceedings.

Article 5 – Intellectual property

All technical documents, products, photographs, texts, logos, drawings, videos, etc. are subject to copyright and are protected by the French Intellectual Property Code. When they are given to our customers, they remain the exclusive property of Ascanium SAS, the sole holder of the intellectual property rights to these documents, which must be returned to it on request.

Our customers undertake not to make any use of these documents that might infringe the supplier’s industrial or intellectual property rights and undertake not to disclose them to any third party without the express prior authorisation of Ascanium SAS.

Article 6 – Hypertext links

The creation by the User of any hypertext links to all or part of the Site is strictly prohibited, unless prior written authorisation has been obtained from the Publisher by sending an e-mail to the following address: ascanium.webdesk@ascanium.com.

The Publisher is free to refuse such authorisation without having to justify its decision in any way whatsoever. Should the Publisher grant its authorisation, such authorisation is in all cases only temporary and may be withdrawn at any time, without the Publisher having to provide any justification.

In all cases, any link must be withdrawn at the Publisher’s request.

Any information accessible via a link to other sites is not under the control of the Publisher, who accepts no responsibility for their content.

Article 7 – Protection of personal data

The personal data collected on this site is as follows:

  • account opening: when the User’s account is created the User may provide the following information: surname; first name; e-mail address; telephone number; postal address; company(ies), country of tax residence, identity document, identity document number; as well as any other information that may be required by the authorities for the provision of the services requested by the User in accordance with the legislation in force.
  • connection: when the user connects to the website, it records his/her surname, first name, connection data, usage data, location data and payment data.
  • profile: when using the services provided on the website, a profile is created, which may include an address and telephone number.
  • payment: when paying for products and services offered on the website, the website records financial data relating to the user’s bank account or credit card.

Article 9 – Applicable law

These general terms and conditions of use are subject to French law.

If the parties are unable to resolve a dispute amicably, the dispute will be subject to the jurisdiction of the French courts.
